HOUSE OF COMBAT RELEASE OF LIABILITY AGREEMENT (“Agreement”)
Waiver of Claims, Assumption of Risks, and Indemnity

To: House of Combat Ltd and its parent, subsidiary and affiliated entities and their respective directors, officers, employees, agents, members, volunteers, independent contractors, representatives, successors, heirs, and assigns (collectively hereinafter referred to as the “RELEASEES”).
Use of “you” herein refers to the below-listed participant (and their parent/legal guardian, in the case of a minor participant):

PURPOSE OF THIS DOCUMENT
1. By signing this document, you waive certain legal rights, including without limitation the right to sue the Releasees in relation to your participation in Martial Arts Activities.
“Martial Arts Activities” mean: Krav Maga, Boxing, Kick Boxing, Muay Thai, Jiu Jitsu, Mixed Martial Arts and other martial arts activities offered by the Releasees including those that feature use of martial arts weapons.
2. If you wish not to waive these rights, you should not sign this Agreement; this will make you ineligible to participate in Martial Arts Activities provided by House of Combat Ltd. Do not participate in any such activities.
FITNESS TO PARTICIPATE
3. You confirm that you are in good physical and mental health, capable of safely participating in Martial Arts Activities that require cardiovascular fitness and physical contact (as further described in this document); you confirm that it’s your responsibility to consult a medical doctor to confirm your fitness before engaging in any Martial Arts Activity.
DESCRIPTION OF RISKS
4. You acknowledge and agree that participating in Martial Arts Activities involves specific and significant risks, hazards, and dangers including without limitation the following, whether related to or arising from the negligence or the Releasees, negligence of other participants, or otherwise:

- Activities that include interaction with other participants or instructors such as kicking, hitting, stretching, grappling, twisting, takedowns, throws, jabbing, rolling, falling, choking, jumping, and joint locks; and
- Activities that include use of various martial arts training weapons and equipment.
5. You acknowledge more general risks, hazards, and dangers associated with use of the facility and equipment including without limitation:

- Tripping, falling, or slipping;
- Dropping equipment or experiencing equipment malfunction;
- Vigorous physical exertion and rapid movements (including quick turns and stops);
- Exposure to communicable diseases such as COVID-19;
- Property loss or damage.
6. You acknowledge and agree that such risks can lead to severe injury that could be permanent, including without limitation:

- Damage to your bones and skeleton (e.g. fractures and breaks);
- Damage to your ligaments and connective tissue (e.g. sprains, tears);
- Concussions or light headedness;
- Experiences that may contribute to mental health issues (e.g. anxiety);
- Bruises or general soreness;
- Spinal cord injuries including paralysis; and
- Serious illness and/or Death.
ASSUMPTION OF RISKS
7. Understanding the risks associated with your participation in the Martial Arts Activities, attendance on the Releasee’s premises, or any other activity related thereto (collectively, “Released Activities”), you:

- voluntarily choose to accept such risks as your own;
- accept full responsibility for any such risks including without limitations risks of personal injury, illness, death, emotional pain, suffering, property damage, and economic loss that you might experience.
RELEASE OF LIABILITY, INDEMNITY
8. You release the Releasees from any and all liability for any loss, damages, injury (including death), or expense you may suffer as a result of your participation in the Released Activities DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE ON THE PART OF THE RELEASEES AND INCLUDING THE FAILURE TO SAFEGUARD OR PROTECTING YOU FROM THE RISKS, DANGERS, AND HAZARDS OF THE RELEASED ACTIVITIES.
9. You hereby indemnify and hold completely harmless the Releasees from any and all claims, demands, liability, and costs (including legal fees) associated with or arising from your participation in the Released Activities.
10. You agree that this Agreement shall be effective and binding upon your heirs, next of kin, executors, administrators, assigns, and representatives, in the event of your death or incapacity.
11. You agree that your executing this Agreement will bar any lawsuit against the Releasees if it is related to your participation in the Released Activities; this is because you have expressly assumed all the risks associated with participation in such activities, including but not limited to negligence on the part of the martial arts instructors in the performance of their duties, negligence by other members of the Releasees, negligence in the operation of equipment, and/or premises liability.
GENERAL
12. This Agreement and any rights, duties and obligations as between the parties to this Agreement shall be governed by and interpreted solely in accordance with the laws of the Province of Ontario and no other jurisdiction. Any litigation involving the parties to this Agreement shall be brought within the Province of Ontario and shall be within the exclusive jurisdiction of the Courts of the Province of Ontario. In entering into the Agreement You are not relying on any oral or written representations or statements made by the Releasees with respect to the safety of the Released Activities, other than what is set forth in the Agreement.
13. SIGNING THIS AGREEMENT, YOU ACKNOWLEDGE THAT YOU AGREE TO THE FOLLOWING:

- YOU ARE ASSUMING ALL RISK OF INJURY, LOSS OR DAMAGE WITH RESPECT TO THE EQUIPMENT, THE ACTIVITY YOU WILL BE PARTICIPATING IN AND THE USE OF THE PREMISES AND FACILITIES;
- YOU ARE WAIVING ANY AND ALL CLAIMS ARISING FROM ANY CAUSE WHATSOEVER AGAINST THE RELEASEES, ON BEHALF OF YOURSELF AND YOUR HEIRS, SUCCESSORS AND ASSIGNS; AND
- YOU WILL INDEMNIFY THE RELEASEES IF ANY CLAIMS RELATED TO YOUR PARTICIPATION ARE BROUGHT AGAINST THEM.

- IF THE PARTICIPANT IS A MINOR, YOU ARE A PARENT OR LEGAL GUARDIAN WITH THE REQUIRED AUTHORITY TO SIGN ON THEIR BEHALF
